Disclosure Long form
I am currently getting a divorce.My
soon to be ex-husband has not
disclosed all his information.We
have been at this since Jan.07.
He was /or his attorney were sent
the papers in May with 45 days to
disclose info. He hasn't,we are set
to do mediation in Nov.He was sent a letter with a 10 day limit to give
the needed disclosure.What would
cause someone not answer a
request from wifes attorney?What
will the consequences be?He should
know to answer he is a deputy
sheriff. He started all of this,found
someone else,after we were 27yrs
into our marriage.Now he isn't
responding.What could be up????????

If he fails to respond then he will eventually be held in contempt of court. Not only will he be held in disdain by the court, financial penalties can be assessed including costs and attorney's fees for the time spent on the motions to compel and hearings or as a last resort, all of his pleadings can be stricken and a default entered against him as if he never filed anything. It is impossible for me to say why he is doing this.
