Disposition of Property

My wife and I are currently in divorce proceedings. Our house is being sold and the profits are being divided 50/50. Although there is no legal separation in FL, she was involved with 2 men in Europe, where she is from. Her passport shows she was out of the country for 8 months in 2001, and 5 months in 2003. During ther first separation, I purchased land in my name. When she left the second time, I sold that land, and with the profits put down a $50k deposit on a condo to be completed Nov/2004. All documents are in my name, and the paper trail has no mention of her name at all.

Her attorney is trying to say $25k belongs to my wife from sale of the land. Is this really a marital asset? Are there any precedents you can refer me to that can protect my condo from my wife? Thank you.

It depends upon where the funds to purchase came from. Only a court order will decide for sure.
