Divorce - Alication

How would a Judge normally rule on Marital Property, say a house paid for by both parties 50/50 over 20 years. And the Husband who has custody of kids has moved out and in with Girl friend, making the martial house empty. Wife lives in apartment.

Absent any other facts,the judge would order the house sold and the proceeds divided between husband and wife.

All things being equal in your scenario, the equitable distribution should be half and half. Looks like its marital property.
