Divorce, Alimony and Child Support

Male friend resides in FL. Wants to divorce his wife (she's had numerous affairs). She saw this coming and has been preparing with a lawyer. He has a lawyer, but his lawyer has basically told him he's out of luck. She doesn't work, but has run up credit cards in excess of $100,000. She is asking for permanent alimony based on her spending habits for the past few years (she needs to be able to continue tolive in the style to whichshe is accustomed) and a new vehicle (the only one she will accept is a Lexus SUV). My friend will be left with approximately 30% of his income each month to live on...I can't believe this is a fair settlement. Is there anything he can do or should ask for?

Alimony depends on many facts such as the length of the marriage, the ability of the paying spouse to pay, the ability of the receiving spouse to go to work or go to school so he/she can go to work, if there are very young kids at home... The lifestyle to which the wife is accustomed is not the only factor. Does the wife have a degree? She may be imputed income even though she refuses to work... There are many questions not answered here.

I would stongly recommend consulting with a second attorney who will evaluate all of the factors involved. It may be that the current attorney does not want to push the issue. It is worth a consultation.

The credit card debt is marital debt and will probably be split 50/50.
