divorce and children

I lost my 3 chidren in 05 because i couldnt afford taking care of them because ex-husband didnt pay so i gave them to him,I wont them back now that Im on my feet. Do I have a chance

There is always a chance to get your kids back! But you must show a substantial change of circumstances. You will need an attorney to guide you through this process. Consult with a Family attorney in your area and he'll tell you what needs to be done. The fact that you can now support them will help.

Hello: I just read your question and the one response. It is an accurate response. I would add that your question is a tough one! Yes, you have a chance of prevailing. However, before an atty. can give you a more definite probability of prevailing, he/she would need to know the facts from the beginning to the present.

If you do file a Petition with the court, you will have the burden of proof. In other words your case has to prove to the Court that there has been a substantial change in circumstances...and...it is in the best interests of the children that they reside with you the majority of the time.
