Divorce and co-habitiating.

Hi, My wife and I are geeting--name removed--divorce. Mutual agreement, no hard feelings, etc. We are living in our house for financial reasons and have--name removed--joint checking account in which we have our money in. I am in need of advice on my rights in regards to her and the house, etc as we are now roomates instead of husband and wife.

In the divorce process, you will be asked to divide up the assets and liabilities that you both had jointly and separately (in your settlement agreement). I would definitely try to agree on things. Disagreements in divorce cost a lot of money. I would also close the joint account immediately and open individual ones if possible. The house may have to be sold if you owned it together or one of you will have to buy the other one out of his or her share unless you decide on giving up other assets that can replace the equity in the house. You can also agree on co-habitation. But, be careful to have things in writing if you can.
