Legal Question in Family Law in Florida

Divorce decree stipulation

My ex-husband was involved in an accident losing part of one leg where he used to work, Winn Dixie. He sued and it was not settled prior to our divorce. However the divorce decree stated I am entitled to 40% of the settlement when it occurred. Just recently he has started spending money quite freely and I suspect he has setttled the law suit. How can I subpoena the information from Winn Dixie? I have the divorce decree stating my portion of the settlement should it occur.

Re: Divorce decree stipulation

Hi:

If your stipulation of settlement was incorporated and not merged into the judgment of divorce and provides what you are saying than you can commence an action for enforcement of the agreement.

I suggest that you speak with an attorney in order to determine your rights and remedies, and would be available for a no cost consultation to discuss this matter in further detail.

If you want to proceed yourself, there should be forms available on the internet that you can fill in the info, file with the court with the proper filing and service fees.

Good Luck
