Legal Question in Family Law in Florida

My divorce is not final yet. However I want to see my daughter and take her to Orlando when I return from Afghanistan in June. Her mother is telling me that if I take my daughter out of the state of Virginia she will call the cops on me, and accuse me of kidnapping!. Is this even possible? My daughter is receptive towards me, she knows I'm her father, she talks to me regularly but my ex- does not want me to live in Miami, FL, let alone bring my child to the state!

I believe you can get an order from the court allowing for visitation during that time. You will need to contact an attorney in Virginia.

Is there any type of temporary time-sharing/visitation schedule in place? Some courts do have rules that children are not to be removed from the state during the pendency of the case.

Your best bet would be to contact a family law attorney in Virginia who might be able to better answer your question.
