Legal Question in Family Law in Florida

divorce

Hi,

I am greencard holder, living in Florida. My husband is resident in Bolivia. I want to divorce.

Can I divorse without his presence in the USA?

If I get divorces, will it be possible to get part of his property in Bolivia?

If he does not cooperate with the divorce (ior does not pay), can he be hold up in customs when he ever enters the USA??

Re: divorce

If you are a legal Florida resident (usually proven with a Florida driver's license issued at least six months before filing divorce), you can file for divorce in Florida. It doesn't matter where your husband lives.

The Florida court can order you to have part of his property in Bolivia, but I have no idea whether a Bolivian court will respect the Florida court's order.

If, for some reason, your husband violates a Florida court order and a warrant is issued for his arrest, it's possible that he will be detained by immigration if he attempts to enter the U.S.
