Legal Question in Family Law in Florida
I am going through a divorce. My husband took our daughter. How do I file an emergency motion for a hearing for child custody? What form do I use? Thank you

The following link is to the Florida Supreme Court's site of approved forms. http://www.flcourts.org/gen_public/family/forms_rules/index.shtml
If you cannot locate a form on-point, just draft one as best as you can.
Where there is either children, real property, and/or substantial assets involved, I strongly suggest retaining legal counsel. This is especially true if the other side has an attorney. If you opt to proceed without an attorney, if things go wrong, you will not be entitled to a "do over". A delay in retaining counsel will not likely save you any money. If an attorney is retained in the midst of ongoing litigation, he may need to expend much time attempting to correct what was previously done in the case.
In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, do not assume that you will not be able to afford to retain an attorney.

An internet inquiry is no substitution for an in-office consultation with an attorney.
If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Dunedin, with a satellite location in Tampa.
