Legal Question in Family Law in Florida

My husband and I lived in Cobb County, GA, until 7-14-08. We moved to Chapel Hill, NC on 7-14-08. Because of our marital problems, I left NC and moved to Miami, FL on 9-25-08 and have been here ever since. My husband left NC approximately 10-24-08 and came to Miami, FL. He rented an apartment and I continued staying with my sister. We never lived together in Florida. My question is, should I file for divorce in GA or FL? He is currently incarcerated in Cobb County, GA.

If all you want is a divorce, you may bring the action in Miami Dade County

SInce you have lived in Florida for more than 6 months you can file in Florida. It would likely be the most convenient location for you.
