Legal Question in Family Law in Florida

divorce law with a not us resident

HI, I am an American Citizen; I got married in Florida, in 1995 with a French woman. In 1998 we separated; she went back to France. She has no green card or any paperwork to be a US resident. We have no kids or proprierties together. ( and I have nothing, also in my own). She was legally in Usa for about one year ( working for Disney) and she has social security.

I am filing for divorce; but she does not agree. I have her address in France. I need more informations for my case; like: what is the process of my case; what is the best and faster way to get the divorce; what are her rights, etc. Thank you for your help. Gc

Re: divorce law with a not us resident

You can petition for dissolution of marriage without her consent. All you have to do is make an honest attempt at notification/service of process by using her last known address and/or publishing notification in a newspaper. If she does not file a response within a certain number of days, the court will enter an order in your favor. Contact a local attorney or if you want to do this yourself, contact the court's self help department for forms and procedures.
