Divorce Mediation

Is it likely that a judge would grant a motion to skip mediation in light of the fact that mediation would be of no avail?

Not likely. Most judges want you to give mediation a try, even if you think it won't be successful. But you never know until you file your motion.

I don't know how you would frame a motion that would automatically convince a judge to forgo mediation. In law you are supposed to try and settle your differences first, then, if that fails you go to trial. I don't think a judge would let you skip such an important part of the process.
