divorce and money

Before filing for a divorce can I legally pull out a large sum of money from our joint checking account?

You could do whatever you want with your money. However, once a divorce has begun, the parties have to file financial affidavits detailing their complete financial situation. Additionally, parties conduct discovery...where you and your atty. investigate the case and prepare for a trial if that is necessary. It would most likely be discovered that you withdrew money. The law on separation of property states anything that came in during the marriage is marital...usually split in half. There are exceptions such as assets that were yours before the marriage or assets from a souce outside the marriage that were given solely to one spouse, such as inherited assets. 'Hope this helps.
