divorce mortgage without being on the deed

my husband and I are divorcing after 27 years of marriage. We have 2 properties one as husband and wife and one he was on with rights of survuvorship with his mother, she's dead. We have a mortgage on that property. I am moving into the other home and plan to refinance it but I do not know what will happen if he can't refinance the other home? how does the court handle that?

Very difficult to answer without knowing the whole financial picture. There are many ways to divide property, the best is by agreement. All the property in the marriage will be considered to belong to both of you unless one of you can prove otherwise.
