Legal Question in Family Law in Florida

possible divorce or separation

My home was mine, 100% paid for 3 yrs. before I even met my husband. If we divorce does he automatically get 1/2 or my home? Or is that up to a divorce lawyer? Also I understand that my stocks and bonds that were 100% mine that I came into the marriage with are completely safe with me and he has no legal access to these holdings . Is that correct. Thankyou for your time. He is foreign with no green card if we divorce should I get an attorney experience in immigration and family law?

Re: possible divorce or separation

Generally, what you came into the marriage with remains your individual property in a divorce. The fact that the house was paid for before you even married helps your case for keeping this asset entirely as yours since none of his or marital money would have been used to pay the mortgage. He may be entitled to a small part of the increase in value that occured during the marriage if certain circumstances occured but I wouldn't worry about it.

As for immigration, he might want to retain an immigration attorney. From the little written here, I don't see a need for you to do so at this point if you were married at least two years. But, it wouldn't hurt to have a one time consultation if you can swing it.
