Legal Question in Family Law in Florida

Divorce trouble

I am in the process of getting divorced but he is not a U.S citizen and disserted me and left for Venezuela. We have no children or personal property, just bills that are unpaid. Which paperwork should I use? and how will the court system be able to get him to pay his part on what he owes? Any additional advice will be much appreciated.

Re: Divorce trouble

Hello: I read your question. Basically, the Court can't make him do anything unless you serve him with a summons, and that may not even matter if he is in another Country (I haven't researched the law on that). You can still file for divorce and follow the law for service by publication (where you publish in a business paper, your Notice of filing the suit against him). Then, the Court will enter a divorce, but will not have personal jurisdiction over him. I haven't researched this issue in a while. I had a case where we did not have personal jurisdiction over one party, so the Court would not order child support from that party. The law could have changed some since I had that case. If my office can be of any assistance, please give us a call. Tom Rosenblum
