Divorce

My wife left our home 4 months ago

and has not returned. She will not

have any contact with me. Isn't this

considered abandonment? Can you file

abandonment? Can I move things out

of our home?

You don't need "abandonment" to file for divorce in Florida, and "abandonment" doesn't do anything to help your divorce case (though it may help you in a custody case). In fact, you don't need any grounds for divorce in Florida, you just have to say your marriage is "irretrievably broken," which pretty much means whatever you want it to.

Yes, you can move things out of the house, but remember, she may be awarded half the value of all the "marital property," so be careful not to damage it.
