Legal Question in Family Law in Florida

We have been divorce for 4 years in Florida. My ex is currently dating (in love with) a man with 2 felonies (1 for aggravated battery, the 2nd for 3rd degree grand theft from the same incident). These happened 8 yrs ago when he was 20. She told me he was 17 when it happened so I am also concerned he is lying to her, or she may just be trying to protect him. Since then all he has had on his record is traffic issues: Driving while license suspended, leaving the scene of an accident, no insurance. He was also just suspended from work for 2 weeks for "mouthing off" according to my 15yr old.

We have 2 children together (15yr girl, 9yr boy), and when I try to discuss things with her she tells me it's none of my business and stay out of her life. My concern is with our kids. Do I have any way to keep a convicted felon away from our children? They like him, I just see bad things down the road and want to be prepared.

He also got visibly angry when I questioned her about his felonies. I was not threatened, but can't take chances.

Unless your children have issues they can express to the a court, I doubt a court will consider your feelings.

Not a good situation but not necessarily a bad one. He is obviously good to the children otherwise they would not like him. Try to stop inquiring about what is going on in the household as to your ex and her BF. Keep you thoughts on how the children are doing and what are they involved with, school activities etc. Talk with the children on those issues only or you may find yourself alienating them from you. I don't believe the court will find fault with your ex as to the children. What you will end up doing if you try to proceed is creating tension that is sure to backfire on you.

What could or may or might happen or your personal concerns are not evidence. Under the law something has to happen. Being with a guy with a record with no other evidence is not enough. Contact my office for free consultation 727-446-7659.
