I need a divorce and have two young children
Im a mother of two boys ages 11 and 6. I was married in Florida but I now live in Roswell.My husband has the boys right now. I've been separated for 14 months now and there is no chance of us reconciling our differences. My husband wont allow me to have joint custody, he forbids it.My boys dont have a stable home environment in fact, they are living with my x-girlfriend most of the time and havent seen their home in about 2 months. I havent paid much for support because I wanted to make sure the money I did send went to their care instead of my husbands bad habits. He's hardly ever home with them and he doesnt tell them where hes going but just leaves them with a 16 year old girl to watch.(My x-girlfriends daughter)My husband works under the table most of the time all tax free. I recently got laid off-I was working for Krogers but am trying to get a new job.Can I file for divorce in Georgia even if I got married in Florida? Thanks for your time and patience. K. Cornett

I disagree with the previous poster in this respect: You can certainly file for divorce in GA, but you can't address the issues of child support, visitation, etc. You should consult with a local attorney about the inter-state conventions that cover whether you can get full jurisdiction in GA.

You must file for divorce in Florida because that is where he now resides. The only way you can file in Georgia is if he consents to jurisdiction here. If you have any further questions, feel free to contact my office.
