Legal Question in Family Law in Florida
I am divorced and my ex husband and i are supposed to have 50/50 custody. I have our son 80%of the time he goes to school right down the street from my house and I take him to school everday and pick him up even when he is over his dad's I have to pick him up on Friday morning and take him to school. I pay for all his schooling, after school programs, medical expenses and his dad pays for nothing. In the divorce decree it says that we have shared custody and we are supposed to alternate filing taxes every year. He pays 220.00 in child support a month. I feel as though I should be able to claim him on taxes. however, he feels that he has the right to claim him this year on taxes yet, now he just wants to refund for the little child support he pays.My ex husband has a house he can claim and makes 16.00 an hour. I make 8.00 an hour and can not find full time work so, I work approximately 20 hours a week. I can only work certain hours because I pick up my son and drop him off at school and he is with me majority of the school week except for thursday night.

It sounds like you have at least a couple of significant issues. If your parenting plan is not working then we need to take a look at modifying it. If the support provided by your husband is not sufficient then we need to take a look at that issue and determine if a modification is in order. The same is true for the issue of the tax deduction. Hope this helps, good luck.
