Legal Question in Family Law in Florida
I am divorced and live in Florida. I receive child support from my ex-husband through an income deduction order. I understand that no more than 50% of his wages can be garnished for child support. He receives a base pay salary + commission. Sales have been down and so has his paycheck therefore I have been receiving less than what the child support order stated. Does he owe me the difference or do I just get what I get? If he does owe it, how and when is it paid?

He still owes you the difference. It just gets tacked on to the end. If he starts making better money, you can have the payment amount increased to where you start receiving some of the back support as part of the regularly deducted payment.
