Legal Question in Family Law in Florida

I was divorced in o3 in Florida. In my divorce decree, it said I had to pay 745 and insurance for my two children until they turn 18. Question 1, when the oldest turn 18, will my support decrease? Question 2, will I have to pay the mother of my children when they go off to college after they turn 18?

Look at your decree. At the age of 18 if your child is a senior but will not graduate until 19, then you will pay until 19 years of age. If your income and your ex's income has not decreased or increased in a substantial amount it may be possible that your support will decrease or remain the same. Unless your decree specifically stated that support would continue for college, I suspect it did not, then you would support according to the decree.

Child support stops at 18 in Florida unless your child has not yet graduated, in which case child support continues until age 19 or graduation, whichever comes first. Unless your divorce papers say otherwise, you do not pay child support during college.

Your child support will not automatically decrease when a child reaches one of the stopping points for support that I described above. You'll have to go back to court to have support adjusted.
