Legal Question in Family Law in Florida

Help; Divorcing Spouse with pension and disability pension

Married 25 years. Grown children. Now separated. Husband has work pension he can collect in 6 years, of which I understand I will get 1/2. BUT, now he is talking about getting out on a disability pension. How does that affect his pension? Do I get any portion of his disability? As I understand it, it will be 65% of his salary untaxed. I work and make decent money, but no pension. I cashed out a pension 5 years ago because ''his'' pension was ''our'' pension. I am 47, He is 48. Please help. Don't know how to proceed.

Pensions are part of the marital estate for purposes of equitable distribution. Since you are now separated are you receiving any temporary support? Have divorce proceedings been instituted?
