Legal Question in Family Law in Florida
divorse/child custody
My lady friend had a one night affair with someone. She continued contacting personvia e-mail. The husband invaded hewr personal email and found the 620 email contacts she had with person. The husband threatened to use conversations about him kids and family, found in e-mails against her, to win custody..are these private e-mails that he violated, evidence against her or is there some rights against self incrimadating herself in this case. The content was all opinions, mostly about the fact that the husband along with his 250 million dollar trust, is controlled by his parents. Please offer any advise on this matter. would much be appreciated

Re: divorse/child custody
Not sure where the divorce would be filed based on your post. The relevance of the evidence could be determined by the state where the divorce will be filed.
If your friend is getting a divorce she should hire an experienced Family Law attorney to represent her in this matter and protect her interests.
If she is in Florida please have her call my office for a consultation.
Re: divorse/child custody
Whether the husband invaded the wife's privacy and if that is right or wrong, I cannot answer. However the information contained in those emails can surely be used as evidence in a divorce and custody proceeding as evidence of adultery. Electronic mail is discoverable.
Re: divorce/child custody
If they are married, such information can be used, and if not it is discoverable.
You should or she should contact an attorney, or contact me for more specifics.
