Domestic violence with a baby invovled

If a mother has a domestic violence injunction against the father of the baby, and the mother as well has laid her hands on him in the past, is there a possiblity of the baby getting taken away from the both of them and put into Custody of the state until family member undergo an investigation? will the both of them have consequences if the mother had documented everytime even police report v. the father and his words and witnesses

Lot of problems jambed into the small paragraph. First, look at how long ago it was that the mother "laid hands" (fought) with the father. If it is recent then there may be police and/or the Dept of Children and Families Services getting involved. Of course, if the Dept feels it necessary to shelter the baby from both parents, the child will be placed in relative care if the relative can pass a home study.

Then there will be a hearing where the mother can present her testimony and documentation, and the father can present his.
