Legal Question in Family Law in Florida
Domestic Violence Restraining Order violations
I want to voluntarily violate the restraining order I requested against my boyfriend, will I get arrested for doing that? My boyfriend was arrested and charged with Physical Battery. He's in jail awaiting the hearing. The day after his arrest I requested a No Contact restraining order against my boyfriend, and it was granted and is good until 2011. But now I want to talk to him (not to forgive him, but to ask him questions about what happened so I can get some closure). If I visit him in jail, could I actually get arrested for violating my Restraining Order against him?

Re: Domestic Violence Restraining Order violations
The restraining order probably forbids you from contacting him as much as it forbids him from contacting you. That's the way it's done in the counties where I practice, though some counties don't include language against you, just against him.
You should file a motion to dismiss the injunction. Then you'll be able to speak with him freely.
