Legal Question in Family Law in Florida

DOR established a child support order in Orange County. We've been to court many times over the $25,000 in unpaid arrears. The court updates the order to add to the arrears, but has not reduced the delinquency to a judgement where interest is charged.

The other parent was in a car accident in another county, and is due a large settlement. More than enough to cover the amount due. What do I have to do to ensure the outstanding child support gets paid?

You have to file a motion to enforce and to impose a lien on the injury settlement proceeds.

Contact DOR or your attorney. The Judge must issue a lien, copies should be sent to the spouses personal injury attorney and the insurance company. If the car crash is in litigation a copy needs to be filed with the clerk of court.
