Legal Question in Family Law in Florida

Due to being unemplyed I have some arrears in my child support payments. The mother of my child requested a court hearing. The court mandated that payment of arrears will be made through monthly payments in addition to the regular child support payments via payroll deductions untill arrears are paid; these payments go to a State Disbursement account . After three months of the court hearing, the State send me a letter demanding full payment of the arrears or actions will be taken, such as intervention of my income tax return and non-renewal or limitation of my passport.

Can they do this?

Yes, the interception of your tax refund is pretty much automatic and the passport or driver's license restrictions are options. However, based upon the scenario you presented, it seems that the "demand" letter you received was more of a form and that the computer that sent that out is not aware that you have already been ordered to pay the arrears. As long as you are paying the arrears as ordered, you should write to the agency that sent you the "demand" letter showing them the order and that you are paying so you have back up when/if you are re-called in to court.
