Legal Question in Family Law in Florida

e-husband will not return child from visitation

I am the primary responsible reisential parent. I live in a different county 4 hours away from my x. He lives in the county where our divorce was filed. My daughter who is 15 has now said that she wants to live with her dad. When they asked me I said no. I have many reasons why. The police can't take her if she does not want to go. School is starting in less than 2 weeks. What do I have to file to get her back home before school starts.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If the police will not cooperate, then you will have to go to the court and get an order requiring your ex to return the child to your residence. Failure to comply will result in contempt of court and could have your ex husband incarcerated.
