Legal Question in Family Law in Florida

Is Email Harrasment a crime ?

First, our attorney is out of the country right now and is unreachable. And I am not sure what to do.

My wifes, ex husband is harassing her with constant insults and intimidation via Emails. Ironic this started when our Attorney left, and wont return for another 2 weeks. She is primary custodial parent. He even trys to tell her exactly what she will do and act with the kids. With that said, my wife is 6 month pregnant. Last night I had to take her to the hospital due to bleeding and contractions. Every time he was harassing my wife via Email, it would cause her to start with contractions. I am afraid what may happen, should this cause us to lose our baby, because of his constant harassing of email. Is there any thing we can do? I guess we could not read the emails, but we do have to pass information back and forth about the kids they have together.

She can petition for an injunction but unless the court finds an immediate and present danger... Depending on what the emails say, the court may rule for her but there's no guarantee. She would get a temporary order valid until another hearing or extension, enough until the attorney's return.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

She can file for injunction but the easier method is simply not to read his emails while the attorney is away. You or your wife can simply block any emails from his email address in your email server.
