In the same day as what? Temporary custody might be awarded if the proper pleadings are filed and the opposing party is given the chance to respond. Absent an extreme emergency which might endanger the health, safety and/or welfare of the child, it is rare that a family court will make a decision like that without at least a cursory investigation and a chance for the other parent to be heard which generally takes time.
