Legal Question in Family Law in Florida

endorsing a check for another

in FL, an adult's mother passed away. she now cares for her 2 younger siblings who are minors. the state continues to send child support to the mother. the father is aware of the mother's death and continues to pay through the state child support depository through income deducation order (or has not yet filed a motion to terminate support). how can the adult daughter continue to deposit the mother's check for care of her siblings until she is able to intervene in child support court and receive the checks in her name? can she deposit the checks legally?

Re: endorsing a check for another

She can't. Because the mother has died, the father is now the custodial parent, and his child support obligation has terminated. The older sister could file a petition for temporary custody (she should see a lawyer if she wishes to do that), in which case the father would likely owe child support to his daughter, the older sister.
