equitable distribution
In an uncontested divorce where all assets and liabilities are divided equally is a 401K account divided in half based on the filing date or the actual date of court ordered divorce?

There are a few dates which the Courts have used to determine when to divide the assets such as a 401(k). The date the parties separated, the date the Petition was filed, the date of the Final Judgment, the date the Judge states or the date the parties agree to use.
