Legal Question in Family Law in Florida

Error typed in Judgment

I received my Final Judgment on Petition to Establish Paternity and For Custody of Minor Child. The line that states my son's name was inadvertently typed in beside another childs' name, I can only assume my attorney at that time was using a template and didn't catch it. What type of motion can I file to correct that error. Someone mentioned that its called scribner's error but I can find anything online about it. I no longer have an attorney and would like to take care of this myself and quickly as possible. Thank you.

Re: Error typed in Judgment

You can file a Motion to Correct a Scrivenor's Error with the Court. Be sure to set forth all of the pertinent facts and the relief requested. A copy must be sent to "the other side", if any.

Alternatively, I would suggest you contact your former attorney and request that he/she correct the mistake. This should be done at no charge to you.

Being without an attorney you can write a letter to the court requesting the correction. Send a copy to the other party's attorney asking if they will not object to such a correction. If they do not you can move ex-parte to correct it without a hearing.
