Legal Question in Family Law in Florida

Evidence and witnesses

I'm Pro Se and my petition to modify custody will probably be scheduled very soon. Because I don't have the luxury of being able to afford an attorney, I have a question for you.

I would like to call a witness and I have no idea how to do that. Do I just bring this person to court with me and ask the general magestrate at that time if she may speak? Do I need to submit a witness list beforehand? If so, do I do that by way of motion or is there some other form I need to submit?

Re: Evidence and witnesses

The witness should wait outside and then be called in when it is time to testify; you can just let the bailiff know this is your witness. Call the judge's office and ask if they are going to require an exchange of witness lists or evidence prior to the final hearing. You may be limited to whatever you produced during discovery. They should issue an order about 45 days before a final hearing letting you know what they expect you to do and by when.
