Legal Question in Family Law in Florida

My exes sister wants to take my two younger kids out of state for 11 days to visit their family. We have an agreement that they will be flying back with a family friend. If they decide they don't want to return my kids can I file kidnapping charges?

You may file a criminal complaint but the charge is up to the States Attorney.
