Legal Question in Family Law in Florida
My ex-husband and I agreed in our Marital Settlement Agreement (which is part of our 2010 Divorce Judgement) that we would split the costs of daycare and medical expenses equally for our child. He has not paid child support in years and I have been the only one paying for medical and daycare. I want to file a document with the court notifying the Court and subsequently Child Support Enforcement of the total amounts I paid for daycare and medical expenses for 2011 and 2012 in case he ever starts paying child support. I have an active Child Support case in Palm Beach County, Florida. What document should I file in Palm Beach County, Florida to notify the court to add these amounts on to our case pursuant to our agreement in the Marital Settlement Agreement? (I do not want to Modify the Child Support - I just want to document this with the court). Thanks

Prepare a spreadsheet of the amounts you paid and the amounts he owes. Also make copies of the receipts for each and every receipt oftherwise you will not get reimbursed. Contact my office for free consultation 727-446-7659.
You will need to petition the court for judgment.
I suggest you file a Motion for Contempt/Enforcement. Doing so will get you an Income Deduction Order place with the additional amount owed stated in the document. The fact is that when you figured your child support amount it would have included the extra. If I can be of assistance, please contact my office for an appointment. 904-997-1031. Having this added to some document prepared by child support division does not allow for the continuance of care and expenses.
