my ex-husband is fighting for custody of our 15 yr daughter, she and i lived in tennessee until a month ago we moved to florida. do we have to do the custody battle in tennessee?

As a general rule, the "custody battle" has to occur where the child has lived for the last six continuous months (in other words, six months in a row). It sounds like, in your case, that's Tennessee, so your "custody battle" probably has to happen in Tennessee.

Has he filed papers yet? If not and you can establish being in Florida for six months, then he will have to file his action here against you.

If you file against him at the present time, you will have to file papers in Tenn.
