If my ex-husband stops paying child support can file for custody of my children and get it? He has them for the first half of the summer and he is currently legally changing his name and is limiting my contact with the children.

If he is in contempt, take him back to court - the fact that he is changing his name does not stop him from being responsible for child support. That fact needs to be noted in the court so that he does not perpetrate a fraud. Find out where he is filing for a name change and let the court know that he is responsible for child support payments. As to limiting your contact witht he children, what does your papers state. If you are to have telehone contact, etc, then file contempt against him and get a pick up order.
