Legal Question in Family Law in Florida

My ex-husband's niece has been living with me since her mother passed away 5 years ago. Her father has never paid any child support but has been in the picture on weekends. He now want to force her to live with him. She is 14years old and does not want to live with him. Is there anything I can do for her to stay with me? Can I go after him for the 5 years of support he has not paid?

You can petition for guardianship and child support. Child support would not be retroactive.

You can also have her testify. She is old enough to state where she wants to live and why.
