Exspouse Tax Problems.

Does an almost exspouse have the right to an almost exwife's future tax filings? The almost exwife doesn't know how her almost exspouse has filed his taxes this year. Whether he filed jointly with his almost exwife or separately as a single. How can she protect herself and their young son? How can she find out what he's done and how he has filed his taxes; so to keep herself safe and protected against her soon to be exhusband and from whatever he has done, since he has been out of the home for almost 1yr.?

There is no obligation for spouses to file joint returns. A spouse can file married filing separately. The spouse who resides with the child would be able to take the dependency exemption. If divorce proceedings are pending, both parties would have disclose their tax returns. Absent divorce proceedings, the only way to access tax returns would involve cooperation with the soon to be ex-spouse.
