Legal Question in Family Law in Florida

My ex-wife & I were divorced in January 2010 in Florida. We decided with a mediator for me to pay $1000/month in child support. Since then she quit one job and was fired from another. She is currently unemployed. Will that change my child support obligation? I have heard that those decisions cannot be altered for 3 years. Also she wants to move to another state without the kids. If she does I'm no longer obligated to pay her is that correct?

No, it is not correct that you would no longer be obligated to pay child support if the custodial parent moves to another state. You will be obligated to pay child support until the child reaches the age of majority. However, if she does move out of state you may be able to petition the courts for a modification of support to take into consideration the money you might have to expend to continue your visitation with the child. You might also be able to have the support amount modified based on her present lack of employment but usually the court will just impute the amount of money she earned in the past to her when they run the child support calculations and you will end up paying the same amount anyway.
