family evection

my parents are both deceased, leaving their home to my self and my 4 brothers. one brother is living in the house, we have requested that he pay rent a number of times. he refuses to do so. are we able to file an evection notice on him.

Re: family evection

First you would have to open an estate for your deceased parents.

Then the Court could order a partition (division) of the property 5 ways. Could order a sale since you can't divide a house 5 ways.

For this you will need an attorney in your county who knows estate work.
