My Fianc� is not my daughter's biological father but he has played that role since and he also signed the birth certificate. After our marriage he going to change her last name from mine to his but he wants do know would he still have to legally adopt her or is he legally binded already?

He would need to legally adopt the child in order to have all the rights ... and legal responsibilities of a natural father. The rights of the biological father would have to be extinguished first.
