my husband has filed for a divorce we both including the child live in FL and in the petition he ask for full custody of our 4yr old daughter. when I contest and enter a response, can I go to another state and try to get full custody of our daughter before a hearing is set by a judge?

It is possible to have two divorces going on in two different states at the same time. However, the court that will take jurisdiction (control) over the custody decision is the one in the state where the child has lived for the last six months.

There are some exceptions to the rule, so you should definitely consider speaking to a lawyer before filing your answer. Call me if you need help.
