I'm being sued for back child support but my spouse didnt have the children all the time his mother had them most of the time and she is willing to go to court and testifly that. Will he be able to collect the back child support?

He may. If there was an order for you to pay child support, and you did not, then the judge may find that you need to pay the back support - not to support your ex, but to support the children. I would have his mother come and testify, however, in case he is being untruthful about where the kids were.
