Family 2 part question
1.If a married spouse is planing on a divorce, can they leave the country with another potential spouse before finalizing the divorce.
2.Can the same spouse legally take the kids out of the country along with them?

More information is needed to give a truly accurate opinion. That being said: Assuming that custody of the children has not been resolved, taking the children out of the state, let alone the country (without the express permission of the other spouse) is a very, very bad idea that will probably hurt your position in the custody battle, and may lead to criminal charges. Leaving the country yourself would be your choice, but your absence makes you vulnerable to several dirty divorce tactics by your spouse�particularly if you do not have and attorney monitoring your case during your absence.
