Father who has not claimed child

I would like to know what right a father who never claimed his daughter (child is almost 5)has over his daughter. HE sees her from time to time never gives child support and he only is really around when we have tried to make a realtionship work. Other than that i do not trust him he has shown up t p[ick ker up drunk etc.. please help

I am not sure from your text whether you want to get child support from him or want him to leave you alone. If you want child support, you can petition the court for determination of paternity and then petition for child support if and when it is determined. If you want him to leave you and your daughter alone, you simply have to ask him since until paternity is determined, he has no rights/claim over either one of you (assuming you are not married to him). If he won't leave you alone, you can request a restraining order (again, as long as paternity is not determined).
