Legal Question in Family Law in Florida

can a father who has no custody of his kid gain custody? How can we prove that the mother is unfit if she keeps telling the fatehr of her kid to keep him longer each time he has the child? Who is more likey to win when the father has the job and not the mother. They are not together.

You can file a Supplemental Petition to Modify Custody if there is an order in place. If not you will have either establish Paternity and request custody through that petition. Or file for a divorce and ask for it at that time. Not sure what you need to file since I don't have all the facts.
